choosing a single international law or area of international law. If you choose an area, I would advise you to choose something relatively narrow. In approximately 8-10 pages, I would like you to provide several pieces of information. TOPIC THAT I CHOOSE IS BORDER SECURITY.
- Provide a brief history of the negotiations that produced the law you are examining. What were the main contentious issues surrounding the negotiation of the law?
- Relate your law to any customary international law or doctrine from natural law that may have preceded it. Tell me how the law changed when it went from natural to positive.
- Tell me about the basic obligations under your law. Who are the parties? What are they supposed to do? What are they prohibited from doing? Are states required to change their domestic laws in any way as a result of international law? If so, in what way(s)?
- How is your law enforced? For example, is there mediation, binding arbitration or any kind of judicial process? Perhaps your law creates a new enforcement body. If so, you should talk about that.
- Provide relevant case law. You are required to choose a law or area of the law that has relevant case law. Pick cases that you can demonstrate relate to items 1-4. Relate the basic facts of the cases, the main legal arguments, how the case was decided (who won and why), and any important precedent that might have come from the case.
Keep in mind that USC Upstate does not have the most remarkable law collection in the world. As a result, you will want to choose laws where there is a lot of information available. Most of the international law books in our library are in the “KZ” section. Books relating to the laws of war and armed conflict tend to be in the “JX” section. Obviously, use the catalog to find resources. JSTOR also has full-text access to a large number of full-text articles. Do advanced searches in the “law” and “political science” sections to look for information. The American Society for International Law (http://www.asil.org) is also a good place to look for information. Finally, as you use the internet in your research, keep in mind the quality of your final paper. Someone who cites peer-reviewed research actual documents is going to perform better than someone who cites Wikipedia articles.
