A seller (named Seller) has found an easy way to sell his huge stash of books. He picks names out of the
telephone book (what in the world is that?) and sends people a letter stating that he will be sending them 3
books at $10 each UNLESS they write back within 10 days and state that they do not want the books. Most
people do not bother to respond to the first letter. Next Seller sends his victims the books (with a copy of his
original dated letter attached) and another letter with some language stating “You are now obligated to pay
me.” Well, the $30 checks keep pouring into his business. If he does not get the money after his second letter,
he sends a 3rd letter in a red envelope, and then he usually gets the money. Two weeks after receiving the 3
books from Seller, Business Law Student sends the unopened box of books back to Seller with big bold letters:
“RETURN TO SENDER” In ink on the bottom of the box, he also wrote a little note to Seller: There was never
an acceptance. Also, my roommate and I read the 3 books you sent him. We enjoyed them, and there was no
acceptance for them as well. Is Business Law student correct about any of this? Explain.
