This recurring debate regarding the proper division of powers between the state and national government has been playing out over the Affordable Care Act since it was signed into law in 2010. I have attached the law for you to review below. After the act was passed, there were several lawsuits challenging the constitutionality of the individual mandate and expansion of Medicaid. The Supreme Court ruled in favor of the federal government on the mandate, but allowed states the right to opt out of the expansion of Medicaid. The fight over the ACA continues as the Trump Administration and Republican controlled Congress sought to repeal and replace this law unsuccessfully. This matter is still on the legislative agenda and Congress may again come back to it in the future. Several Democratic candidates for President made health care their key issue advocating for further federal involvement in the health care system (e.g. Medicare for All plans).
