Law&the Legal System

"Luke, a man in his mid-20s with a long history of criminal convictions and his partner, Lisa, a college dropout in her late teens live with their three young children in a council flat, claiming state benefits. Luke did some work as a plasterer on a zero-hours contract for a local builder. One day, Luke and Lisa were invited to a pub-gathering of old friends and decided to leave their three children at home. Lisa fed them milk mixed with a small quantity of sleeping pills and put them to bed. Luke then drove their van which had no tax or MOT or insurance to the Bull & Bear Pub, a couple of miles away from their home.

At the pub, Lisa got into an argument with Luke’s ex-girlfriend, Becky, who happened to be there. Lisa swore at Becky and swung her handbag at her but missed and ended up smashing a crystal candle holder on the table. A glass fragment flew into another pub-goer, Mark’s eye causing him pain and irritation in one eye.

Luke’s best mate, Tom gifted him a sachet of “spice” which Luke gratefully received. By then, Luke had consumed eight pints of cider and Lisa, four large glasses of wine. They decided to drive back home. Adam, an off-duty PCSO who had been in the pub witnessing the chain of events was not bothered to take any action as he did not want to spoil his night out.

Upon reaching their block of flats, Lisa inserted the key into the main door of their neighbour, Jordan, thinking that it was her own. When Jordan opened the door, Luke lunged at him shouting “What are you doing in my flat, you fat slob?” Jordan ran back into his flat pursued by Luke who then pushed him against the second-floor window. Unknown to them, the wooden window sills of the council flat had rotted and gave way under the weight of Jordan, causing him to topple over. Jordan died as a result of his injuries. "
