Both parties executed a Lloyd’s Open Form Salvage Agreement, (LOF) and included a SCOPIC clause into the LOF. The Swansea Town was lying in shallow water off the coast of Italy after running aground in a storm. The Swansea Town was leaking large quantities of crude oil into the sea when the team from Glossy Salvage Ltd arrived on the scene. It was decided that the first step was to get the crew off, which was achieved and then Glossy Salvage Ltd tried to tow The Swansea Town into deeper waters away from the coast in order to limit pollution damage. In the course of doing this The Swansea Town broke in two and sank. Glossy Salvage Ltd has claimed a salvage payment but has not been paid. Advise Glossy Salvage Ltd.
