Scenario
You work for a security management firm as a consultant. You are preparing security training for a new client. You want to use a recent liability case for the
Starlight Nightclub so that your client can protect itself from similar risks. You will create a security risks presentation highlighting the lessons learned from
this case.
The case involved a nightclub in Portland, Maine. The shooting took place in January 2019. During a dispute between patrons inside the nightclub, a
nightclub staff member seized a handgun while breaking up the fight. One patron (Jason) accused another (Adam) of “hitting on” his girlfriend. The accused
patron’s brother (George) stuck up for him, and things started to get heated between Jason and George. Jason was in possession of a gun, and one of the
staff members took Jason’s gun away and put it in the back room. Once things settled down, the staff member returned the gun to Jason. The men started to
argue again, and the staff asked the men to take their argument outside. They did as instructed. They went outside and continued the fight. After the fight
escalated, a gun was fired and hit an innocent bystander, Linda Thomas, 27, who nearly died from her injuries. In 2020, Thomas filed a civil complaint against
Starlight Nightclub for negligence. Negligence is a legal term. It refers to conduct that falls below the standard of behavior that would protect others against
unreasonable risk of harm.
The detailed civil complaint filed by the shooting victim is available for review in the Supporting Materials section. It contains a detailed account of the
incident. Local and state officials including the Department of Liquor Control had been investigating the situation. It is important to note that the complaint
represents the point of view of the victim only. This means it is biased in favor of the victim. Nonetheless, you will be able to see all of the threats and
vulnerabilities the victim’s attorneys have discovered in the process of filing the complaint. The concerns all need to be addressed regardless of who is found
to be at fault for the shooting. Concerns include the club’s responsibility for the actions of the staff that contributed to the shooting. With responsibility
comes liability, which is the responsibility to pay for damages. The shooter (Jason) has pending charges against him, while the man who pulled the gun on
the shooter has no pending charges.
Directions
Using the forensic methodology found in the textbook (Appendix A), review the details of the case and then create a presentation with speaker notes for your
client. Address each section of the presentation and answer the questions provided. Note that the first three questions were part of your assignment in
Module Five, so use the information you gathered to create your presentation.
