Part A
In order to encourage sport and healthy livin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing, the London Borough of Mayfair decided to hold a race where anyone runnin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing from Oxford Circus Tube Station to Nelson’s Column in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in Trafalgar Square,
would be paid £1,000 if they completed the race within" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in 15 min" rel="nofollow">in" rel="nofollow">in" rel="nofollow">inutes. The race was to commence at 10.00am on Sunday 9 October 2016 and was widely advertised in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in the daily Mayfair Gazette.
After seein" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing the notice Nicola decided to enter the competition and duly arrived at the Oxford Circus Tube Station startin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing position at 10.00am ready to start the race. At the start of the race
(10.00am), Sylvie was out for her usual mornin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing run along Oxford Street, and seein" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing the other runners decided to join" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in. Sylvie had not seen the advert for the race in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in the newspaper.
As both runners approached the fin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">inishin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing post within" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in 10 min" rel="nofollow">in" rel="nofollow">in" rel="nofollow">inutes, their attention was drawn to a notice set up by the Mayfair Gazette. The notice stated that the prize money had been withdrawn and
congratulated the runners on bein" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing healthy.
Advise Nicola and Sylvie if they are entitled to claim the prize money.
Part B
After the race Sylvie decided to book a holiday for her partner and two children. She decided to visit her local travel agent Tours R Us, and noticed a brochure which described the holiday as:
An amazin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing Spanish resort. Enjoy the fresh food daily, fantastic cocktails and relaxin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing spa experience in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in our luxury Sharz four star hotel. For those that like excitement, there will be pool
parties on Friday and Saturday nights. The cost is only £600 (per person), and in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">includes flights and two weeks accommodation at the Sharz Hotel with spectacular views. If you book this week you will
also be entitled to a free tour.
Sylvie booked and paid for her holiday the same day as she had just received a bonus from work. A week before departure Sylvie’s son was diagnosed with a virus, and was advised not to fly for at
least three months. Sylvie’s nephew was more than happy to take his place, however Tours R Us did not allow Sylvie to transfer the bookin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing to him. Tours R Us also told Sylvie that she would have to
pay an additional £50 for her holiday due to a system fault (at the time of bookin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing) with Tour R Us computers.
Sylvie has just returned from her holiday and is disappoin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">inted. She contacts Tours R Us and refers to the description in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in Tours R Us brochure. The Sharz hotel was not as described in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in Tours R Us
brochure, and the view outside of the hotel rooms was blocked because of scaffoldin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing and buildin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing works takin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing place in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in the hotel. The food did not match her expectations and consisted of chips,
sausages and beans most days. On most occasions the dessert was still frozen and the cocktails were not of high quality. As a result Sylvie and her family had to spend extra money eatin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing outside
the hotel, which amounted to an additional £600. On arrival Sylvie and her family found out that the tour was cancelled due to staffin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing issues. To make matters worse the spa was closed on most
days, and the pool parties took place in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">in the children’s paddlin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing pool. Tours R Us were aware of this at the time of the bookin" rel="nofollow">in" rel="nofollow">in" rel="nofollow">ing, but failed to in" rel="nofollow">in" rel="nofollow">in" rel="nofollow">inform Sylvie.
Advise Sylvie as to any rights she may have again" rel="nofollow">in" rel="nofollow">in" rel="nofollow">inst Tours R Us USING the Package Holiday and Package Tour Regulations 1992.
