The Case

A longtime employee of the Bechtel Corporation was terminated when his work unit was eliminated. He sued for (1) breach of an implied contract to be terminated only for good cause; (2) breach of an implied covenant of good faith and fair dealing; and (3) age discrimination. The court ruled that his employment contract was “at will” and no “implied covenant” can decree otherwise.

The Ethical Questions

Is it ethical to terminate long‐time employees without good cause? What are the best arguments for and against?

1.From the 3 major ethical theories, why is duty based theory more helpful to use for the above ethical question over utility theory and virtue based theory?

2.From the 3 corporate personhood theories, why does business as ethical persons theory offer more helpful insights for the above case and ethical question?
