Liability is the legal obligation to compensate another person for losses incurred. Medical malpractice is a type of professional liability that occurs when a healthcare professional causes harm to a patient through negligence.
Three areas of general liability for which a physician/employer is responsible:
- Vicarious liability: This is liability for the actions of others. For example, a physician/employer may be vicariously liable for the actions of their employees, such as nurses or medical assistants.
- Corporate liability: This is liability for the actions of the organization itself. For example, a physician/employer may be corporately liable for the actions of their hospital or clinic if they fail to provide adequate supervision or training to their employees.
